1. Who we are

This platform is operated by HGE LLC (the “Operator”). The Operator hosts user-generated content and tooling for oyster restoration, social commerce, and creative work. By using the platform you agree to these terms.

2. Your account

Accounts are invite-gated. Each account is yours: you control its content, its credentials, and its recovery. The Operator cannot reset a password or recover an account without at least one of: a verified email address, a 12-word mnemonic backup, or a paired device. Lose all three and the account is permanently locked.

3. Your content (uploader liability)

You are the uploader, and you are responsible for what you upload. By submitting content (text, audio, video, images, code, …) to the platform, you represent and warrant that you own it or have the rights to publish it. The Operator does not pre-screen content and is not liable for content posted by users. Uploader liability rests with the user who posted the content.

You retain ownership of your content. You grant the Operator a non-exclusive license to host, transmit, cache, and display your content as required to operate the service.

4. Copyright and DMCA

If you believe content on the platform infringes your copyright, file a DMCA takedown notice under 17 U.S.C. § 512 via the form at /legal/dmca-takedown. Your notice must include the elements required by § 512(c)(3)(A): your contact information, identification of the copyrighted work, the URL of the allegedly infringing material on the platform, a good-faith statement, an accuracy statement under penalty of perjury, and your physical or typed electronic signature.

The Operator’s designated DMCA agent (registration pending at copyright.gov) acts on properly-formed notices within 24–72 hours. Counter-notices are accepted from the affected user under § 512(g).

4.1 Repeat infringer policy

Pursuant to 17 U.S.C. § 512(i)(1)(A), the Operator terminates the accounts of repeat infringers. A user who accumulates three or more sustained takedown decisions within a rolling 12-month window is suspended; an additional sustained takedown after suspension may result in permanent account termination. Counter-notices that are sustained reduce the user’s strike count.

5. Prohibited content

Do not upload: content you do not have the rights to publish; CSAM or content sexualizing minors; doxxing or harassment material; malware or active-attack payloads; spam; or content that violates applicable U.S. federal or Florida state law.

6. Service availability

The Operator runs the platform on a best-effort basis. There is no uptime guarantee. The platform is provided AS-IS without warranty of any kind.

7. Termination

You may delete your account at any time. The Operator may suspend or terminate accounts that violate these terms, with or without notice, including under the repeat-infringer policy in § 4.1.

8. Changes to these terms

The Operator may update these terms. Material changes will be posted at this URL with a new effective date. Continued use after the effective date constitutes acceptance.

9. Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Florida.
